1      Legal Agreements

 

Welcome to ReachIn-Out, a photo and messaging application offered by Noble Truth, a 501(c)(3) public charity. With this application, you can send color photos as well as written text to inmates incarcerated at state and county correctional facilities. Federal facilities may be added in the future.

 

By using ReachIn-Out (“The App”, “RIO”), you indicate your agreement to the terms and conditions and policies stated below. If you do not agree to these terms and conditions of usage, please exit the website application now.

 

Noble Truth may update these terms and policies over time, and you are advised to read all the agreements listed below in full. By using the RIO app, you are acknowledging that you agree to these terms, conditions and policies.

 

 

1.1   RIO Terms of Service

 The application assigns a cost for each page, where:

n  The first page is always the “cover page” and includes your text.

n  The second page will contain your first photograph.

n  The third page will contain your second photograph.

n  The maximum number of photos you can upload is ten(10), unless the facility is configured to allow more within the RIO app.

n  These pages are collectively referred to as “The Packet” (cover page and all uploaded photos).

 

The application charges you once for each packet. Each packet represents one transaction.

There is no limit to the number of transactions that you can create using the application.

 

Your packet will print on better-than-average quality paper at our Noble Truth office; i.e. the RIO app will not deliver your packet electronically to the correctional facility.

Once printed, we inspect all packets to ensure that they do not contain any inappropriate content. Note that packets containing inappropriate content will NOT be delivered. We are not responsible for these undeliverable packets. Please familiarize yourself with the target correctional facility’s terms and conditions for sending mail.

 


 

1.1.1      Facility Selection

The App presents the user with a list of correctional facilities that it currently recognizes.

As of 9/3/2019, the App recognizes approximately 130 facilities, located primarily in the state of Texas. The App does not have direct communication with federal, state or county databases, so it cannot verify or confirm that a given inmate (inmate number) is housed within any given facility. It is therefore incumbent on the user to select the proper correctional facility.

 

If the desired facility is not shown, please refrain from usage.

However, the user however is encouraged to write to Noble Truth at info@NobleTruthTexas.org to have additional facilities added to the application’s list of facilities.

 

Noble Truth does not have any agreements in place with federal, state or county correctional facilities.

You may therefore not hold these facilities nor Noble Truth liable for any rejected packets.

 

 

1.1.2      Inmate Number

To properly use the application and ensure that your packet is successfully delivered, it is imperative that you enter the target inmate number precisely as it appears on file with the corresponding facility.

 

For example, if the department of corrections inmate number is “00012345”, you MUST enter the number as shown with the leading zeros. If you enter “12345”, your packet may not be successfully delivered.

 

n  If the department of corrections inmate number is “00012345”, do not enter “12345”. Include the leading zeros.

n  If the department of corrections inmate number is “V00123”, do not enter “V123”. Include the leading zeros after the letter “V”.

 

Your packet may not be delivered if you do not enter the inmate number properly.

 


 



1.2   Proper Usage

Please keep your RIO username and password confidential. Never share these details.

If your account is compromised, you can reset your password on the RIO logon screen, or write to us at info@NobleTruthTexas.org. Your usage of the app must comply with all federal, state and local laws and regulations.

 

Examples of improper usage and content include but are not limited to:

a.     Abusive, stalking, threatening or harassing language or images

b.     Nudity, child nudity, pornographic or obscene language or images

c.     Sexually explicit content or language

d.     Any depiction of graphic violence

e.     Any content depicting discrimination based on race, gender, disability, religion, nationality or sexual orientation

f.      Any content showing illegal activity, controlled substances or related paraphernalia

g.     Any gang related content or images

h.     Any information prohibited from receipt by inmates at the receiving correctional facility

i.      Any content that infringes on or violates the rights of other entities, including their privacy rights, their intellectual property rights or their publicity rights

j.      Any language or images that defame, or are abusive, libelous or fraudulent to a person or entity

k.     Commercial usage of the application by a third party or other business entity. This includes advertisements, spam, mass notification communiques

l.      Content containing computer viruses, malware, trojan horses or any malicious code

m.   Any content or code intended to hack the Noble Truth or RIO application site

 

Remember that the correctional facility publishes definitions of inappropriate content on their respective websites. You are advised to familiarize yourself with those publications.

 

Neither Noble Truth or its web developers or other affiliated agents will be held liable for the inappropriate usage of the RIO app.

 

Anyone using the app to send confidential information or images should not assume any degree of privacy. Packets will be routinely inspected by Noble Truth as well as the receiving correctional facility.

If you are a lawyer and you use the app to communicate with inmates, expect no degree of confidentiality or privacy.

 

Noble Truth reserves the right to deny anyone access to the app who violates the usage guidelines specified above. Abusers of this policy will have their RIO accounts removed. If you feel your account has been unfairly removed, please write to info@NobleTruthTexas.org and explain why you feel this is so.

 


 

1.3   Packet Delivery – United States Postal Service (USPS)

 

Once printed at our office, your packet will arrive via USPS in three(3) to five(5) business days.

Once the packet arrives at the correctional facility, it may take another one(1) to three(3) business days for officers to deliver the packet to the inmate.

Please note that these are the most accurate delivery estimates that we can provide at this time. Actual delivery times may be less than or greater than the total times presented above.

We inspect all packets to ensure that they do not contain any inappropriate content. Note that packets containing inappropriate content will NOT be delivered. We are not responsible for these undeliverable packets. Please familiarize yourself with the target correctional facility’s terms and conditions for sending mail.

 

1.3.1      Undeliverable Packets

If the correctional facility refuses to accept your packet, it will most likely be sent to the return address provided when you created your RIO account. Noble Truth can not guarantee the disposition of your packet if it is rejected by the receiving facility.

 

If Noble Truth deems your packet to contain inappropriate content, your packet will not be mailed. If you would like undeliverable packets sent to you, please write to info@NobleTruthTexas.org. A fee will be charged.

 


 

1.4   Payment

To pay for the delivery of your packet, the app will direct you to the PayPal© website, where you will enter payment details. There, you will be required to enter Credit/Debit card information or your PayPal Credit account details. Please realize that the PayPal© terms and conditions apply, as well as those of this app.

Refer to the ReachIn-Out App Privacy Policy for an explanation of how we use the information you provide to the app.

You will be charged based on the total number of pages in your packet, as described above in the

RIO Terms of Service.

 

You are also required to pay any additional fees that may be charged by PayPal©. In addition, you are responsible for any fees levied by your bank or financial institution, including charges for insufficient funds.

Some credit card companies may consider your payment to the RIO app as purchasing a “service” and may therefore consider the transaction as a “cash advance”. In this case, the institution may impose additional fees and/or interest rates for the transaction. Noble Truth has no control or jurisdiction over this.

If your payment is denied, your RIO transaction will be canceled, and your packet will not be delivered.

 

1.5   Refunds

Once your transaction is finalized and printed at our Noble Truth offices, no refunds can be provided. Please ensure that your packet contains only content that meets our Proper Usage statement, shown above. If the receiving facility refuses to deliver your packet to its recipient (inmate), no refund will be given.

 

 

 


 

1.6   Privacy Policy

When you create an account in the RIO app, you consent and grant us approval to collect and store certain pieces of information.

1.6.1      Collection of Info You Provide

We store the following pieces of information that you give to us:

n  Your name

n  Your address

n  Your contact info, including email address and phone number

n  The inmate number and correctional facility, where your recipient is incarcerated

Note that this data is publicly available via most correctional facility websites

This information is used initially to create your RIO account, and subsequently used to identify you as a valid user of the RIO app. It is also used to execute sales transactions within the RIO app.

We may use your contact information to send you a copy of our monthly Newsletter, and to inform you of promotions that we offer.

We do NOT store credit card information or CVV codes in our RIO database.

 

1.6.2      Collection of Info – Using Our Service

By using the application and paying for the service, we will store certain pieces of data from the resulting transaction, including the RIO Transaction ID and details, as well as some datapoints resulting from the PayPal© transaction.

 

1.6.3      Users who are underaged

Usage of the RIO app is intended for those 18 years old and older. We do not intentionally collect information of those under the age of 18. Parents and legal guardians who suspect that an underaged person has used the RIO app can notify us at info@NobleTruthTexas.org.

 

1.6.4      RIO Usage of Cookies

The RIO app uses cookies to enable certain functionality(s). If you disable the usage of cookies in your web browser or device, the RIO app may not function as intended.

 

1.6.5      Sharing Your Info

None of the information you provide, nor datapoints generated when using the RIO app is ever shared with outside agencies or third parties. We also do not sell any of this information to outside agencies or third parties.

 

1.7   Texas: Governing Law

These Terms and Policies are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regards to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of any State or Federal court located Harris County, Texas, United States of America, and waive any jurisdictional, venue or inconvenient forum objections to such courts. If any provision of these Terms and Policies, or the application thereof to any person, place or circumstance, will be held by a court of competent jurisdiction to be invalid, void or otherwise unenforceable, such provision will be enforced to the maximum extent possible, or, if incapable of such enforcement, will be deemed to be deleted from these Terms and Policies, and the remainder of these Terms, Policies and such provisions as applied to other persons, places and circumstances will remain in full force and effect. No waiver by either party of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default, nor will any delay or omission on the part of either party to exercise or avail itself of any right or remedy that it has or may have hereunder operate as a waiver of any right or remedy. This is the entire agreement between us relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements between us with respect to such subject matter. These Terms and Policies are not assignable or transferable by you. You may not sub-license these Terms and Policies under any circumstance. These Terms  and Policies may not be modified or amended. Any heading, caption or section title contained in these Terms and Policies is inserted only as a matter of convenience and in no way defines or explains any section or provision hereof.
